The laws that created rooms for periodic elections into 1, 695 elective public offices in Nigeria, which the Independent National Electoral Commission (INEC) is empowered to conduct, also allow rooms for Elections’ Petition Tribunals (equivalent of high courts) to handle judicial petitions arising from the conduct of such polls, with a view to determining the authenticity or otherwise of such polls. Such petitions are filed by aggrieved parties. Matters that are brought before polls’ tribunals are those that have to do with the conduct of the polls proper. In the Constitution of Nigeria, 1999, as amended in 2011 and the Electoral Act of the Federation of 2010, governorship poll tribunal cases start at the tribunal (high court) and terminate at the Supreme Court (three steps).
The Constitution envisages that contestants are likely to be aggrieved. And, in true democracy, such situations are given the best opportunity to be addressed, so that true democracy is not only achieved but also seen, by the majority, to have been achieved. This is where the constituting of Osun State Election Petition Tribunal could be situated.
Despite the open and widespread knowledge in Osun State and beyond that candidate of the opposition Peoples Democratic Party, PDP, Dr. Iyiola Omisore was not a match to the incumbent governor Rauf Aregbesola in electoral contests, as clearly demonstrated through the ballots on the 9th of August, 2014, the former still went on to challenge what was and is still regarded as a clear victory to the incumbent.
Analysts have argued that this is nothing but a gross abuse of the tribunal, or judicial, process. The result of the election that gave victory to Ogbeni was incontrovertible as there was no serious reported case of irregularities or violence in areas where he gained victory to warrant going to the Tribunal despite provocations on the ruling All Progressive Congress, APC, in the state by agents of the federal government which backed Omisore with every conceivable arsenal. If there was any violation, it certainly came from areas where the PDP candidate had some perceived advantages. But because the law has the duty to entertain even the most ridiculous petition as stated above, the process had to be followed through.
From the beginning of the hearings at the Tribunal at the Osogbo High Court, to the tendering of exhibits through to the presentation of Petitioner’s Witnesses, it was nothing but a case of the absurd. We had the annoying, the abusive, the funny as well as even the entertainingly ridiculous, which I term the Awada Kerekeri scenarios.
In the Yoruba entertainment scenes, Awada Kerikeri is the comedy genre meant to relief tension after a serious day at work. Comedies and comedians are often injected into serious drama scenes to put our nerves at bay. So, whatever happens in comedy series and scenes are often taken for what they truly are- Comedy-unserious, footnotes and extraneous. The petition of Iyiola Omisore, the loser of the August 9, 2014 gubernatorial election in Osun State, is nothing other than Comedy, or, Awada Kerikeri, where the participants, including the Chief Petitioner himself, his so called witnesses and his band of supporters are nothing but Alawada, or comedians.
It is rather too unimaginable that a petitioner would claim irregularities in 85 polling units of the 105 of a local government area and call only 3 witnesses whose only evidence is, in most cases, by proxy, or hearsay, which he knows is clearly inadmissible in law. As a Petitioner’s Witness, by definition, you ought to be the first-hand witness to the event in contention. You are not supposed to present third party information. And even then, calling 3 witnesses representing only 3 polling units of the alleged 85 in my native Ikire, Irewole Local government example is nothing but absurdity and a waste of time and deliberate plot to distract the government of Osun. What happens to the remaining 82 polling booths where you claim irregularity that made you lose the election? The picture painted above also represents what the Petitioner was claiming in virtually all the other local governments contested.
More bizarre is the fact that the Petitioner called a witness in respect of unit 4 ward 6 of Ejigbo Local government area of the State to prove that the election result from this unit was invalid. Ejigbo has 68 polling units, and the petitioners are challenging 49. Interestingly, the result of the Unit 4 had been cancelled during the election by the Presiding Officer for malpractices perpetrated by PDP agent and supporters in the polling unit! Do these Petitioners know what they are doing at all trying to invalidate an already invalidated result?
So, why seeking to invalidate an already invalidated result, if not to waste time and distract governance?
The above absurd scenarios played out in all the 17 local governments in contention by the Petitioners.
From the above analysis done on a Local Government by Local Government basis, it is crystal clear that out of 965 Polling Units being challenged by the Petitioners, they only called evidence in support of their petition in only 239 Polling Units with the abandonment of 726 Polling Units pleaded in their petition. Assuming, without conceding, that the Petitioners have led credible evidence in all the 239 polling units (which is not the case here), is that enough to sway the judgment in their favour? 239 Polling Units represent 7.94 per cent of the 3,010 polling units contained in the State. This is definitely too insignificant to upturn the result of the gubernatorial election held on August 9, 2014.
To make matters worse, the Petitioners tendered Form EC8A in respect of only 230 units which mean that even if their claim succeeds in respect of the 239 Polling Units in which evidence was led, the Tribunal can only rule in their favour in respect of the said 230 Polling Units in which Form EC8A was tendered.

Government of Osun State has cautioned farmers and Fulani/Bororo herdsmen in the state to avoid activities arising from the grazing of farmlands that could cause conflicts but rather see themselves as partners.
Speaking in Osogbo during a one-day conference organised for Fulani/Bororo and crop farmers in the state, the chairman of the committee on harmonious relationship between Fulani/Bororo herdsmen and crop farmers in the state, Hon Mudashiru Toogun expressed joy that conflicts between the two groups have reduced since the committee was set up.
He pointed out that the administration of Ogbeni Rauf Aregbesola values the safety of lives and property hence the approval for the conference to be held as well as a peace committee involving all the stakeholders be set up in all local governments in the state.

The Governor of Osun, Ogbeni Rauf Aregbesola, has said Nigerians should consider the February elections as very critical for the much desired change they had longed for.
Aregbesola observed this yesterday at the Special Thanksgiving Service organised for him at the Freedom Park, Osogbo by the national headquarters of the popular Islamic organization, Nasrul-Lahi-il Fatih Society of Nigeria (NASFAT).
This was just as an Islamic scholar, Prof Hafis Oladosu, harped on the need for governance and expressed optimism that the governor’s second term in office will be more productive than the first.
Aregbesola stated that the general election will bring a leader (General Muhammadu Buhari), who will turn around the much eroded fortunes of the country for the better.
The governor explained that even though the nation is going through a lot of vicissitudes, he expressed confidence that after the February elections have shown Nigerians new leadership, things will begin to change for the better.
He lamented the dastardly acts of people who hide under the banner of Islam to perpetrate their atrocities, saying these kinds of people do not preach or represent Islam in whatever form.
He argued that the prophet of Islam, Muhammad, suffered the worse forms of humiliation during his time and he never contemplated revenge.
“Nigeria is today in its trying moments. Everything has stood still. But I want to assure you that this is just a passing phase.
“By February, the general election will sure usher in the much needed and much expected change.
“We need to pray and work diligently for the peace and progress of the country. And this is why we must seriously condemn the activities of some individuals who hide under Islam to perpetrate evil.
“There is no written law or directive either from Qur’an or Hadith that directs Muslim to unleash terror on fellow creatures.
“No one can fight God’s battle for Him. And I don’t see where Islam orders anyone to kill, maim or unleash violence on people because of faith.
“There was no form of humiliation Prophet Muhammad did not suffer in the hands of the unbelievers, yet he did not think of retaliation. Rather, he showed understanding and love to his adversaries,” Aregbesola said.
The President of NASFAT, Engineer Kamil Bolarinwa, earlier in his speech, said for a country to be great, there must be justice, fairness and security of lives and property of the entire citizenry.
Bolarinwa stated that Nigeria has been facing a lot of challenges in these areas, which has slowed down growth and development of the country.
The NASFAT President equally observed that one of the cardinal objectives of Islam is the spread of peace to the entire world, irrespective of the obnoxious activities of some insurgents to soil the name of the religion.
He said, “Like any other country in the world today, our country Nigeria, faces enormous challenges – lack of peace and security, justice, fairness, economic development, lack of infrastructure, youth unemployment and the rest.
“Without peace and security, justice and fairness, we cannot move from our current position as individuals, as Muslims and as a country.
“Peace and security are at the core of the resolution of many of the challenges we face today.”
He commended the governor for his government’s observance of justice, equity and fairness among the diverse people of the state, adding that his (governor’s) sterling performance in his first term in office was a clear testimony of his being just and fair to all in all ramifications.
The lecturer at the occasion, Professor Afeez Oladosu of the Department of Arabic and Islamic Studies, University of Ibadan, enjoined the governor to always be just and fair to all and sundry in whatever he does as the governor.
Prof Oladosu, who revealed that the governor has become a brand in the country, said the governor should make sure that his second term is not inferior to his first term on the performance index.
According to the don, what the people of the state desire is for their state to become one of the best in the country in terms of development, growth and security of lives and property.
“Position of authority comes from God. As governor, you must do what your people will remember you for.
“You have indeed become a brand in our politics today. Therefore, you must ensure that your performance in second term should not be inferior to your first term.
“Always let justice, equity and fairness guide your government’s policies and programmes to all categories of people,” Oladosu said.
Governor of Osun, Ogbeni Rauf Aregbesola, on Friday said the Nigeria has lost N2.2 trillion (14.6 billion dollars) to oil theft within a year under the President Goodluck Jonathan-led Peoples Democratic Party (PDP).
In a release by the Director Bureau of Communication and Strategy in the Office of the Governor Semiu Okanlawon Aregbesola was quoted as speaking in Akure after the Walk for Change programme that saw a huge population of residents of the state joining the All Progressives Congress vice presidential candidate Prof Yemi Osinbajo to sensitise the people on the need for change of government in Nigeria.
Walk for Change in Nigeria is a civil society organisation, which is interested in sensitising Nigerians for the necessary change in the country.
The governor revealed that Nigeria loses 400, 000 barrels of crude oil to oil theft everyday according to Federal Government statistics.
According to him, 400, 000 barrels at the conservative figure of 100 dollars a barrel translates to 40 million dollars loss to the country on daily basis.
Aregbesola lamented that what the country lost to oil theft in a year is more than the total amount of what all 36 states gets as allocation in four years.
“If 400, 000 barrel of oil is stolen everyday and the President can say so, it is disheartening.
“From July 2013 to July 2014 if we calculate what the nation is losing by 100 dollars, Nigeria loses 40 million dollars daily to oil theft.
“What we lost in just one year to oil theft in a year is more than the total amount of what all the 36 states of the federation get as allocation in four years.
“This is not a way to develop a country. Nigeria is being bled to death by some unscrupulous individuals.
“We shall not remove them through the barrel of gun or by violence. We are going to chase them away with our votes.
“If this amount is spent on education alone, we will have the best of education; if spent on roads, we will have the best of road network system.
“Today, we are neck deep in poverty, underdevelopment and socio-political and economic stagnation.
“No power can surpass or suppress the will of the people whenever they resolve to change what they do not like,” Aregbesola said.
He added that the February general election is for the people to vote for development and growth and a signal to an end to poverty and misery.
He urged the people to quickly go and collect their permanent voter’s card so as to be able to vote for change.
The Vice-presidential candidate and the running mate of Gen. Muhammadu Buhari, Prof. Oluyemi Osinbajo stated that APC when voted into power come February 14, will be the first government in Africa to institute a social security welfare for its citizens.
He added that the APC government when sworn-in May 29 will change the Country from poverty status to that which citizens will have abundance and once more be proud of the nation.
Osinbajo also added that the coming of APC will usher in a government of the masses which will focus on youth employment and infrastructural development in all ramifications.
He said, “our government which will also be your government on assumption of office will employ twenty thousand youths in every state of the country and agriculture will be given a major priority.
“Every pupil of primary schools in Nigeria will be fed free every school days in every state, it will also be a government where health care and other sectors will be adequately catered for by government”. The vice presidential hopeful explained.
The walk for Change which took off from the Buhari Campaigns Officr took the huge population of residents who came out through Oba Adesida Road and terminated at the Fiwasaye Junction.
The shouts of Change and SaiBuhari rent the air for the period the walk lasted.

The Election Petitions Tribunal sitting in Osogbo, Osun State, has ordered the candidate of the Accord Party, Mr. Niyi Owolade, to pay N50,000 to the 1st respondent, Governor Rauf Aregbesola.
The petitioner was also ordered to N50,000 each to the 2nd respondent, the All Progressives Congress and the 3rd respondent, Independent National Electoral Commission.
It subsequently dismissed the petition filed by Owolade.
Owolade, through his counsel, Mr. Jacobs Adedayo, had at the resumed hearing on Thursday announced the withdrawal of the petition.
The counsel had moved a motion dated January 8 and told the court that the petitioner decided to discontinue with the case because the panel would not be able to conclude the mater within 180 days allotted to it by the Electoral Act.
The first respondent, Governor Rauf Aregbesola did not raise any objection to the application to withdraw the petition.
Aregbesola, who was represented by his counsel, Mr. Wale Afolabi, however, prayed the panel to award a cost of N5 million against the petitioner.
Counsel to the All Progressives Counsel, Mr. Basiru Ajibola, also did not object the petitioner’s application but he said all the grounds of the application were “ speculative, hypothethical, and calculated to scandalise the judicial process of the tribunal.”
The APC’s counsel asked for a cost of N10 million against the petitioner.
Counsel to the Independent National Electoral Commission, Mr. Ayotunde Ogunleye, also did not object to the application of the petitioner.
He described the petition as a gross abuse of court process which he said should not be tolerated.
He also asked for a cost of N25 million against the petitioner.
The tribunal frowned at the grounds upon which the petitioner based his application to withdraw the petition.
The chairman of the panel subsequently dismissed the petition and slammed a cost of N50,000 which he was ordered to pay to each of the three respondents.
It will be recalled that the panel had on Monday adjourned until January 28th for the adoption of written addresses by the parties involved in the petition filed by the governorship candidate of the Peoples Democratic Party, Senator Iyiola Omisore, to challenge Aregbesola’s victory.

Osun State chapter of the Nigeria Union of Teachers has suspended it’s “sit down” strike by its members, saying that government has begun to supply instructional materials to some schools.
The teachers embarked on the strike in December, 2014, because of inadequate supply of instructional materials and non-payment of leave grants by the state government.
The suspension was announced in a statement by the NUT Chairman and Principal State Secretary, Wakeel Amuda and Abdulahi N.M. respectively.
A copy of the statement made available to our correspondent yesterday, directing the teachers in the state to resume duty reads: ” The Nigeria Union of Teachers, Osun State Wing, hereby, suspends the ongoing sit-down strike embarked upon by the union due to lack of instructional materials, non-payment of leave grants to secondary school teachers since December, 2013, non-payment of running grants to primary schools for the last six terms and non-payment of running grants to secondary schools for the past three years.
“The above decision was made due to an agreement reached between the government of the State of Osun and the Nigeria Union of Teachers on 6th January, 2015. All teachers in primary and secondary schools are, hereby, directed to resume classes and work in line with the available instructional materials. No teacher is expected to run the school from his or her personal purse”, it added.
Public Relations Officer of the union, Comrade Boye Abodurin, told our correspondent that government had begun to supply instructional materials in schools.
“We have requested for instructional materials and the government has started supplying up to middle schools and they promised to supply that of high schools,” he added.
Head of Service, Mr. Sunday Owoeye, blamed the inadequacy of instructional materials on the reduction in the allocation accruing to the state from the Federation Account.
The government, according to the statement, agreed to address various demands of the union by August 1, 2015.

The city of Osogbo capital of Osun on Wednesday stood still as the vice presidential candidate of the All Progressives Congress Prof Yemi Osinbajo joined thousands of residents in a walk for Change procession.
The rally tagged “Nigerians walk for change (Buhari/Osinbajo)” drew people from all the adjourning towns and villages who trooped to the streets to join the team on a physical exercise by walking through the major streets.
The team and crowd snaked through streets like the popular Oke-fia, Alekuwodo, Olaiya, Oluode market and ended at the Osogbo township stadium.
Walk for Change in Nigeria is a civil society organisation, which is interested in sensitising Nigerians for the necessary change in the country.
The All Progressives Congress Vice-presidential candidate noted that by February I4, God will grant the people of this country the New Nigeria they desperately craved for.
He pointed out that the APC government when sworn-in May 29 will change the Country from poverty that has bedevilled it under the Jonathan led government to wealth and prosperity.
The Vice-presidential hopeful held that the coming of APC will usher in a government of the masses which will focus on youth employment and infrastructural development in all facets of life.
Osinbajo promised that the government on assumption of office will employ twenty thousand youths in every state of the country.
He added that Agriculture that the Jonathan led administration is attending to with kid gloves will be given its rightful priority ahead of the monolithic oil economy.
Osinbajo also added that pupils of primary schools in Nigeria will be fed free every school days in every state, noting that health care and other sectors will be adequately cared for.
According to him, “I want to seize this opportunity to thank you all for turning out for this walk. I want to assure us all that God will grant all of us our heart desire of a new Nigerian where life will be more abundant.
“This new Buhari/Osinbajo government that will be coming in come May 29 will be the one all of you it will be government that will bring the change we have all been yearning for.
“Our first priority will be the employment of twenty thousand youths in each of the states of the Federation, Agriculture, care of vulnerable elders among every social needs will be accorded priority, and we will have life more abundantly”. The vice-presidential hopeful noted.
Osun governor, Ogbeni Rauf Aregbesola, while speaking at the gathering lamented that the Government of Jonathan has brought untold hardship to the people of the nation.
He stated that the poverty bedevilling the country today is alarming and beyond the thinking of every reasonable people.
Aregbesola said it is pertinent for the people of Osun and by extension, the entire country, to support Buhari/Osinbajo for the much desired change in Nigeria.
“Osun is solidly behind Buhari-Osinbajo candidacy. It is compulsory to support the APC in its bid to turn around the fortune of Nigeria.
“The government of Goodluck Jonathan had for close to six years brought untold hardship to the people of the nation.
“We must therefore join hands with Buhari-Osinbajo team to rescue the teetering ship of our dear country.
“With Buhari as President, all the nation yearns earnestly for will be done within a short period of time.
“One paramount duty we must, as a true citizens of this country, perform in February is to vote wisely and vote for Buhari. A vote for Buhari’s is a vote for development, growth and abundance.
“A vote for Buhari is a vote for an end to poverty, misrule and insecurity in Nigeria,” Aregbesola said.
Earlier in his opening remarks, the Chairman of APC in Osun, Prince Gboyega Famodun, observed that Yoruba nation has never been sidelined in the politics of the nation since the days of independence.
Famodun said the Goodluck Jonathan government has relegated the Yoruba people to the background in the political configuration in the past six years.
The chairman noted that it was so sad that a Yoruba man could not even be counted among the top first six political slots in the country.
He stated that the government of Muhammad Buhari has a Yoruba man as Vice President, urging the people of the South-West to vote massively for Buhari/Osinbajo team for the much needed change in the country.
The speaker, Osun House of Assembly, Hon. Najeem Salaam said the presidential election of February 14 in Osun will be a repeat of what happened in the 2011 election when Osun voted massively for the ACN presidential candidate, Malam Nuhu Ribadu.
Salaam stressed that the party is sure of Victory for Buhari/Osinbajo come February 14 this year.
Convener of the Walk for Change Nigeria Mr. Bola Ilori, said The huge crowd that turned our for the walk show that Nigerians are resolved to remove the PDP.
” Nigerians cannot afford to miss it at this time when the country has been destroyed economically politically and socially. Everywhere you turn you see misery on the faces of people. The Buhari and Osinbajo team provides us the answer,” he said
