Friday, 6th February, 2015 must have gone down well as another day of defeat for the Osun State chapter of the Peoples Democratic Party (PDP). If anything, it amounts to an icing on the cake for the victory secured at the poll by the Governor of Osun State, Ogbeni Rauf Aregbesola.
It was a day the PDP lost on all grounds in the 17 local governments it contested the outcome of the August 9, 2014 governorship election. PDP had approached the Election Petitions Tribunal to challenge Aregbesola’s victory in the August 9th 2014 governorship poll.
Couple of days to the judgment, PDP executives had reportedly procured colourful uniform attires (aso ebi), distributed to their members and bought cows which were to be slaughtered in celebration of an anticipated victory at the tribunal.
Alas, their expectations were not met; they went home empty-handed. The rest is history as the PDP suffered its second defeat in a row within six months.
But beyond the victory is the conduct of the tribunal, the soundness of the judgment and the thoroughness with which the tribunal members handled all the matters before it.
To start with, the PDP governorship candidate challenged the result of the elections in 17 out of 30 local governments in the state.
And on judgment day, the 3-man election tribunal left no one in doubt that the judgment will not be brief because of the litany of issues involved even though early enough, the tribunal had given clear indications of where the pendulum was swinging.
The judgment thus lasted seven and half hours with every issue closely scrutinized before pronouncement. Again, the tribunal chose to pronounce its judgment and went on also to adduce facts and give reasons for arriving at the judgment they gave.
For instance, the Chairman of the tribunal, Justice Elizabeth Ikpejieme, in her judgment on the eligibility of the petition brought by PDP and Omisore ruled that Omisore failed with his inability to file his reply within the five days stipulated under the law.
The tribunal Chairman held that the five days the appellants had, according to 2010 Electoral Act (as amended) commenced on the day they were served on 9th October, 2014 and lapsed on 13th October, 2014 saying the days under the law included Sunday which the appellant tried to exclude from the five days.
According to her, the filling of the case by the Appellant of the reply on 14th October ran counter to the law, saying that the law is settled when it stated the method and dates to follow in filling reply.
Beside the issue of abandonment of the case by the Appellant, the tribunal noted that for the purpose of fair hearing, the tribunal would go on in delivering its judgment on the substantive case.
In essence, the petition ought to be thrown out ab initio for failure to file the petition as and when due as stipulated by law.
Yet, the tribunal, in an attempt to uphold one of the pillars of natural justice – Fair Hearing – did not throw out the petition based on technicality.
Rather, it chose to look at the petition on its face value and then pronounce on it. Good for the judiciary that this panel did not do a shoddy or lazy job or go on an adjudicating jamboree.
In their unanimous decision, the tribunal gave reasons for its decision in all the contentious grounds.
It was after this painstaking examinations that the tribunal pointed out in its judgment that the PDP and its candidate, Iyiola Omisore failed abysmally to prove their case in the 17 local governments being challenged, holding that the petition lacks diligent prosecution and substantial evidence.
Not done, the chairman held that, for the petitioner not to have satisfactorily proved his case in any of the 17 local governments, the panel has no reason to void the election.
Hence, the tribunal returned Ogbeni Rauf Aregbesola the duly elected governor in the August 9 election and dismissed the case of the petitioner.
Given the theatrics that preceded the delivery of the judgment by the. tribunal, it was no surprise that the entire Osun state went wild in jubilation in apparent applause of what was believed was another instance in the Judiciary holding its head high up in a country where sleaze has crept into every aspect of national life.
It was a matter of anxiety whether the judiciary would upturn what the people who voted were convinced was the accurate outcome of their electoral decisions on August 9 2014 or justice would be seen to have been served.
The current attempt by the Judiciary to cleanse itself of the bad eggs is a as a result of the many cases of perversion of the cause of justice in recent political history of the country. That the National Judicial Commission (NJC) had wielded the big stick on some erring judges over amazing perverted verdicts are ample reasons to believe that sleaze had entered that revered arm of the government.
Could the PDP have bought the judgment of the tribunal and that was the basis of their jubilation ahead of the actual delivery of judgment? That was the question on the lips of many as they watched with bated breath the decision of the tribunal.
Agreed that there was no substance in the Omisore/PDP petition which was the position that the tribunal eventually took, the orchestrated jubilation days before the verdict was delivered became a matter of concern to the mass of the Osun people who could not but wonder on the basis of the pre-judgment celebration by the PDP loyalists.
It would definitely go down as a classical case of illusory grandeur; one ballooned by ignorance, crass ambition and baseless optimism to have ever dreamt that something good could come out of the candidate’s journey to the tribunal.
This was why even INEC’s counsel alongside other two counsel also submitted that Omisore’s petition lacked merit and should be thrown out because of paucity of evidence.
It therefore will amount to standing logic on its head for the PDP and Omisore to laugh last as they built nothing on something. In law, this can’t stand.
And when the judgement was finally delivered, the evidential castle upon which Omisore and PDP had built on a quicksand crumbled like a pack of cards.
Beyond rhetoric, the Osun Tribunal has set a standard for other tribunals in the forthcoming elections.
Explicit judgement like that of Ikpejime, many have come to admit, would accentuate the appeal of such petitions at the Court of Appeal should the Appellant proceed to the appellate court.
The people of the state await what Omisore’s next move will be. Appeal, if he heads towards that, is a foregone conclusion with the Ikepime judgement of February 6.

Health, an adage says, is wealth, just as a healthy nation is a wealthy nation hence there is no amount spent by a nation to ensure a healthy people that can be said to be too much.
Yet just as it is not possible for a nation to be solely responsible for the education of its citizenry, so also it is imperative for individuals, corporate bodies, agencies, non governmental organisations among others to complement government’s effort to achieve the goal of ensuring that people are healthy.
Therefore when a non-governmental organisation, Seri Care Foundation (SCARF) a pet project of the wife of Osun State governor, Alhaja Sherifat Abidemi Aregbesola decided to wipe away the tears of over 500 people suffering from various ailments, their joy knew no bounds.
The passion for people with one ailment or the other but lacked the fund to undertake the medical treatment of the diseases informed the medical outreach embarked upon by the woman who has concern for the well being of the down trodden.
Having gathered that there are people suffering silently in the hands of such ailments like lumps; hernia, hydrocele, ganglion among others and cannot afford the fund to get themselves treated by medical professionals, Alhaja Aregbesola took it upon herself to find solution to their predicament by organising a health outreach sponsored by her foundation.
Seri Care Foundation (SCARF) organised a three-day medical surgery outreach between Wednesday, January 28 and Friday, January 30, 2015 where no fewer than 530 persons were operated and treated free-of- charge.
They were also provided with drugs free-of-charge while those with complicated cases were referred to teaching hospitals for further surgery and treatment on the bill of the organisation.
Three beneficiaries of the medical outreach were each referred to teaching hospitals for further medical examination and treatment. One of the patients was referred to Ladoke Akintola University of Technology (LAUTECH) Teaching Hospital,Osogbo, Obafemi Awolowo University Teaching Hospital (OAUTHC), Ile-Ife and University College Hospital (UCH) in Ibadan for further treatment.
The surgery operation which took place at the Oke-Baale Primary Health Centre, Osogbo was initially meant to focus exclusively on the treatment of breast lump for about 300 patients but the unprecedented crowd that responded to the radio and television announcement of the programme forced the organiser to exceed its initial figure and at the end of the third day, 530 persons went through surgery.
Surprised by the unprecedented crowd that turned out for the medical outreach, out of passion, the organiser is proposing having the second phase of the programme sometimes in June this year to take care of those that could not benefit under the first phase.
The medical team that performed the surgery was drawn from Lagos University Teaching Hospital (LUTH), University College Hospital (UCH), Obafemi Awolowo University Teaching Hospital, LAUTECH, Osogbo with support from Osun State medical team led by Dr. Segun Laogun.
The equipment used was purchased by the foundation with an indication that the outreach will be a continuous exercise as soon as its finances improve.
Performing the flagging off of the medical outreach, the founder and wife of the governor, Alhaja Serifat Aregbesola appealed to the state lawmakers to expedite action on the passage of primary healthcare bill so that the state can join others in benefitting from the implementation of the National Primary Health Care Act.
She explained that the programme was meant to assist the people whose daily lives are threatened by these conditions, adding that this is the second time the foundation will embark on such mission.
Alhaja Aregbesola noted that the maiden health programme by the foundation was to benefit the elderly persons and the children and took upon itself the responsibility for the payment of medical bill of a child who was treated for heart impairment.
She said, “I thank God Almighty for the reality of the programme. It is by His grace that the programme which is designed to bring joy into the homes of our people is holding. The focus of the programme was initially exclusively for the treatment of breast lump. This was to assist women and create awareness on combating the scourge of breast cancer.
“We believe in the golden principle of reaching out to the needy and the under-served. Our objective is to contribute our quota towards enhancing the standard of living of our people who critically require basic needs of life. We believe this will help to compliment the development efforts of the state government.
“As it is well known that health is the most important need that every human being requires and it is upon this belief that the board and management of this foundation resolved to put in place this medical outreach.”
She explained that her foundation was committed to ensuring that the people of the state live healthy life irrespective of their economic situation and social status. Mrs. Aregbesola declared that the management of the foundation has “however, resolved to expand the coverage to include other cases following reports from the medical team that quite a number of men also suffer from such diseases which are different from breast lumps.
The head of the medical team, Dr. Okikiola Alaba from LUTH explained that most of the beneficiaries of the surgery operation cannot in any way afford the cost, adding Alhaja Aregbesola out of passion has promised to ensure that the second phase comes up in June this year.
Also speaking, Dr. Segun Laogun posited that a huge sum of money had gone into the project which cannot be quantified, adding that a lot of people were locked inside suffering for one ailment or the other and lacked money for treatment of their cases.
He therefore appealed to those that could not be attended to during the first phase of the programme that their roll calls had been taken and registered, adding that they will be the first to be attended to under the second phase.
The chairman of Osogbo Local Government Council under whose domain the programme was carried out, Mr. Isiaka Faramade appreciated the wife of the Governor for the gesture describing the exercise as unique.
One of the beneficiaries, Mrs. Aderolake Ajao was full of appreciation for Mrs. Aregbesola, saying that the state government under the watch of her husband, Rauf Aregbesola has brought succor to lot of people
through his people oriented programmes and policies since his assumption of office.
She recalled her agonizing experience before the intervention, adding that if not for the free programme she would have continued to suffer till death comes.

Osun State Governor, Ogbeni Rauf Aregbesola’s commitment to create more local government has been described as a giant step towards grassroots development.
The All Progressive Congress (APC) House of Assembly candidate for Obokun constituency of the state, Olatunbosun Oyintiloye, disclosed this Monday after participating in the referendum conducted by the state Independent Electoral Commission (OSSIEC) for the creation of new councils at his Isale-Alfa Unit 9, Ward 1, Obokun Local Government Area.
Oyintiloye, who commended the initiative of the governor as well as the exercise, noted that the local government creation initiative would deepen good governance.
The governor had presented a bill to the state House of Assembly for the creation of additional 27 local government areas.
He also lauded the state legislature for supporting the governor to achieve his course by directing the commission to conduct the referendum in compliance with the constitution.
According to him, the referendum conducted by OSSIEC has shown that the government is actually serious about the creation of new councils, and committed to meet all legal, technical and constitutional procedure for the exercise.
Describing local government as the closest government to the people at the grassroots, he said the creation of new councils would further bring development closer to the people.
“The move by Ogbeni Aregbesola administration to create more councils has clearly shown that he is indeed a governor of the people that would do everything necessary to ensure the development of the state.
“Eventhough the governor has been doing this since the inception of his administration, he has not relented in his efforts, inspite the dwindling resources of the state.
“The state House of Assembly also deserved commendation for supporting the governor to achieve the milestone of creating new councils that no democratic government has been able to achieved since the creation of the state”, he added.
Noting that the referendum was aimed at feeling the impulse of the people on the exercise, he added that the massive participation of the people in the referendum has shown that the government shared their views.
He urged the OSSIEC to fast-track the submission of his report on the referendum to the legislature for the Assembly to work on it, with a view to ensure that the motive of the exercise is actualised.

OSUN State, Governor Rauf Aregbesola, at the weekend, affirmed that the postponement of the general election by six weeks would never change Nigerians’ resolve to have new leadership at the federal level on May 29.
He said the will of God and peoples’ desire for a positive change would bring about responsive and good governance, through the All Progressives Congress (APC), during the March 28 presidential poll.
Aregbesola, who made this disclosure on Saturday, during a prayer session organised for the presidential candidate of the APC and his running mate, Major-General Muhammadu Buhari and Professor Yemi Osinbajo, respectively, in Osogbo, urged eligible voters to use their permanent voter cards (PVCs) to chart a new and prosperous course for the nation.
He maintained that apart from Nigerians, who were tired of alleged PDP’s misrule in the last 16 years, the global community was also anxious over the emergence of better managers of the nation human and capital resources.
According to Aregbesola, “the postponement of the general election from February to March and April was an unwarranted development in the country’s democratic experience. It is shocking and the reasons advanced for the postponement were not genuine.
“The presidential election had been fixed for over a year, so why the sudden rescheduling of the date over flimsy excuses. INEC did not contemplate shifting Ekiti and Osun governorship polls for poor PVC collection.”
In his address, former Commissioner for Information and Strategy, Honourable Sunday Akere said the prayer session was to remind the people of the state that on Saturday, February 14, Nigerians should have gone to poll to elect the president for the country.
He explained that the postponement will not change the resolve of Nigerians to vote for Buhari and Osinbajo adding that the federal government only delayed the obvious victory of Buhari.

All Progressives Congress, APC, in Osun State has described the Peoples Democratic Party, PDP’s recent tactics to elongate the transition programme as the greatest threat
to democracy in the country.
The APC, in a statement in Osogbo, recently, by its Director of Publicity, Research and Strategy, Mr Kunle Oyatomi, noted that the PDP, “unless it pulls back from its desperation to stay in power at all costs, it may very well self-destruct and in the process, terminate the current democratic dispensation in Nigeria.”
The statement read in part : “In a clinical assessment of the actions of the PDP in the last four weeks, which has led to the postponement of the February 14 presidential polls, and in the run up to the new date of March 28, the PDP is again flying two dangerously destructive kites.”
The APC claimed that it had come to the conclusion that the PDP has become the greatest threat to the survival of the current democratic dispensation in Nigeria.
According to the APC: “The foremost leadership of the PDP and its strategic operatives appeared to have lost all sense of caution, responsibility and concern for the survival of democracy in Nigeria and would do any and everything abominable to retain power. The PDP is not even bothered that already what it has caused the country, in terms of economic and political instability as a result of its abortion of the February 14 presidential election has patently overheated the polity.”

In her quest to promote Islam as a non-violent religion and find enduring solutions to terrorism, the Muslim World League has invited the Governor of Osun, Ogbeni Rauf Aregbesola, to speak at a discussion in Saudi Arabia.
According to a statement by the Director, Bureau of Communication and Strategy, Office of the Governor, Mr. Semiu Okanlawon, Aregbesola will be in Saudi Arabia to discuss how to correct the erroneous impression of Jihad and terrorism and proffer lasting solutions to the worsening scourge.
Governor Aregbesola has been very vociferous in his condemnations of the activities of insurgents in parts of Nigeria and other places around the world where terrorism has caused untold carnage.
The meeting will come up at the King Abdullah bin Abdulaziz AlSaud in Mecca between the 22nd and 24th of February this year.
The Muslim World League is interested in ending the danger of terrorism and the impact of its propaganda on the Muslim community across the world.
According to the invitation letter addressed to Aregbesola, “We are planning to convene a conference on ‘COMBATING TERRORISM’ under the leadership of the custodian of the two Holy Mosques King Abdullah bin Abdulaziz Alsaud. It will by the grace of Allah hold in Makkah between 3rd and 5th/5/1436 -22nd to 24th February2015.
“Muslim World League is inviting you to a partnership in this regard to, together, stimulate discussion on the causes of this conflict”.
Governor Aregbesola has been very consistent and persistent in using every medium he has to condemn acts that have continued to paint Muslims in bad light.
As late as January 15th 2015 on the occasion of the Armed Forces Remembrance Day, Aregbesola had restated his position on the need for a dogged war against insurgents.
Specifically, the governor had in the past also identified acute poverty as a major source of strength for the insurgents arguing that terrorists would run out of suicide bombers if all governments address the problem of poverty.
He had cited various authorities to strengthen his position that issues of faith are personal and that it is not Islamic to compel anyone to follow one’s own faith.
Ahead of the general elections in the country, candidates contesting state and National Assembly posts in Osun State, yesterday, signed a peace accord pledging to abide by rules and regulations laid down by the legal framework for elections in Nigeria.
They did this as the Assistant Controller of Prison, ACP Adelakun Kayode, warned political parties and their supporters to maintain peace, saying prison yards are wide open for any one that causes political trouble before, during and after the elections.
“Tell your supporters to be mindful of their utterances and if they fail to heed advice, prison yards are wide open and are expecting people,” he warned.
Representatives of political parties and some candidates at the state police command pledged to avoid any conduct or behaviour that may endanger the political stability and security of the state.
They also pledged to refrain from campaign of calumny, hate, religious sentiments, ethnic or tribal profiling.
Speaking at the accord meeting, the Assistant Inspector General of Police, Ikemefuna Okoye, assured that the police will ensure protection of lives and property without bias or prejudice.
Okoye however warned that any candidate or supporters caught fomenting trouble would be arrested and prosecuted accordingly.
State Chairman of All Progressives Congress, Prince Gboyega Famodun, promised that his party will not go contrary to the pledge, urging the police to remain apolitical and fair to all parties.
Also, the State Secretary of Peoples Democratic Party, PDP, Prince Bola Ajao, said that the party will continue to promote peace despite its loss of the governorship petition at the tribunal.
Director of State Security Service, Andrew Iyokia, State Director of National Orientation Agency NOA, Dr Martins Lawrence, INEC Resident Electoral Commissioner, Dr Adekunle Ogunmola, and other security agency leaders, urged political parties to keep to their promise and take the nation’s interest above personal and partisan concerns.

In a bid to find a lasting solution to the lingering leadership crises at the Osun State University, the governor of Osun, Ogbeni Rauf Aregbesola on Tuesday evening set up a five-man visitation panel to the university.
The governor during the setting up of the committee at the Executive Chambers of the Governor’s Office in Osogbo, admonished universities in Nigeria to be problem solvers rather than creating it.
The visitation panel is to be headed by Prof. Adebiyi Daramola, while Prof. Jacob Ladipo, Prof Omotoye Olorode and Mr. Babatunde Adebayo are members with Mrs. Oluwakemi Kolawole, secretary.
The governor pointed out that the panel shall investigate the basis of the simmering crisis and the misunderstanding between the Management and the Council in the university with a view to finding a lasting solution.
He also charged the panel to determine the roles of individuals and groups in the crisis, with a view to recommending appropriate steps to arrest the ugly situation and prevent a reoccurrence in the future.
The panel, according to Aregbesola, will also proffer solutions to address the issue of disintegration in relationship between students in the institution with special reference to the Ikire Campus.
He urged the visitation panel to complete its assignment and submit their report within four weeks after the inauguration.
The governor said, “As you are aware of late there has been some disquieting dust being raised in the institution. The Ikire campus was shut until recently. Now, the management and Council are at loggerheads.
“When a university is thrown into crisis, the non-curricular teaching the students freely take away is the fighting, disorder and disorganisation. Whereas, the ultimate learning they should take away from the university is problem solving skills, and not crisis generating capability.
“Worse still, the energy of the combatants will be dissipated in writing petitions, counter-petitions and fighting, instead of positively deploying it to teaching, mentoring young and impressionable minds and conducting researches.
“This unintended consequence of the university system regrettably has been a reoccurring feature in Nigeria,” Aregbesola pointed out.
He held that universities should direct their research into existential challenges faced by the society, by first solving its own problems, which he described as being similar to those of society.
Aregbesola noted that university can make its environment beautiful, clean, and run it with sustainable resources, which it can easily transfer to the society.
“I find it troubling therefore that our universities are not problem solver but crisis generators. We want to end this and return UNIOSUN on the path of its founding mission”. The governor stressed.
Aregbesola admonished the committee to be fair and listen to all the sides, noting that they should leave no stone unturned by following the truth and care less about stepping on toes.
Speaking, the Chairman of the visitation panel, Prof. Adebiyi Daramola thanked the governor for giving them the opportunity to serve.
He noted that the committee will try his best to bring out the truth without any fair or favour and that members of the panel will not be short of courage in the discharge of its duties.
He said, “I want to use this opportunity to thank the governor for having confidence in the panel. We will not be short of courage in getting to know the truth of what is happening in UNIOSUN.
“There is something fundamentally wrong with governance in the country. What is happening in the university is a reflection of what is going on in the country. The problem in UNIOSUN is that of governance problem,” The chairman averred.
“The commission hereby assures Mr. Governor that we shall do our work to the best of our ability within the set time frame,’’
